Terms of Service

These Terms of Service (“Terms”) form a binding agreement between you and Bookisty(“we”, “us”). By creating an account or using Bookisty(the “Service”), you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 13 years old (or the minimum age of digital consent in your country, where higher) and able to form a binding contract to use the Service. If you use the Service on behalf of an organization, you represent that you are authorized to bind it to these Terms.

• You agree to provide accurate, current information and keep it up to date.
• You are responsible for safeguarding your login credentials.
• You are responsible for all activity that occurs under your account.
• Notify us promptly of any unauthorized use of your account.

You agree not to:

• Engage in any illegal activity or violate any applicable law.
• Upload content you do not have the right to use, or infringe others' copyrights or intellectual property.
• Send spam or distribute malware or harmful code.
• Reverse engineer, decompile, or attempt to extract source code, except where permitted by law.
• Scrape, harvest, or use automated means to access the Service abusively.
• Harass, abuse, defraud, or harm others.
• Circumvent security or rate limits, or interfere with the Service's operation.

You retain ownership of the content you upload. You grant us a worldwide, non-exclusive, royalty-free license to host, store, display, and process your content solely to operate and provide the Service to you, including transmitting it to AI providers to generate your study materials. You represent that you have the rights to the content you submit. We may remove content that violates these Terms or the law.

The Service, including its software, design, and branding, is owned by Bookisty and protected by intellectual property laws. Except for the rights expressly granted to you, we reserve all rights in the Service.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for your personal or internal use. You may not resell, sublicense, or commercially exploit the Service, or reverse engineer it except where such restriction is prohibited by law.

• The Service is offered as a subscription that may include a free trial. Current pricing and trial length are shown at checkout.
• A valid payment method may be required to start a trial. Subscriptions renew automatically until cancelled.
• You can cancel at any time; access continues through the end of the current billing period.
• You are responsible for applicable taxes. Payments are handled by our third-party payment processor.
• Refunds: all purchases are final and non-refundable. That said, if something goes wrong with the Service, contact us at support@bookisty.com and we'll work with you to make it right.

The Service relies on third-party providers (such as hosting, authentication, payment, email, and AI providers). Your use of those services may be subject to their own terms, and we are not responsible for their acts or omissions.

Bookisty uses AI to generate summaries, explanations, quizzes, and flashcards. AI output may be inaccurate, incomplete, or out of date. It is a study aid, not professional, legal, medical, or academic advice. You should independently verify important information against the original source before relying on it.

We may modify, suspend, or discontinue the Service, in whole or in part, at any time. We do not guarantee that the Service will be uninterrupted, timely, or error-free, and we provide no uptime guarantee unless stated in a separate agreement.

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law.

To the maximum extent permitted by law, Bookisty will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or content. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or USD 100.

You agree to indemnify and hold harmless Bookisty and its officers, employees, and agents from any claims, damages, liabilities, and expenses arising out of your content, your use of the Service, or your violation of these Terms or applicable law.

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or use the Service in a way that may harm Bookisty, other users, or third parties. Provisions that by their nature should survive termination will survive.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules, except where mandatory consumer protection laws of your country of residence apply.

Any dispute arising from these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in California, and you consent to their jurisdiction and venue. We may update these Terms from time to time. We will revise the effective date above, and continued use of the Service after changes take effect means you accept the updated Terms.
